Please read these terms and conditions carefully before using this website and software operated by FastCodeFix.com. FastCodeFix.com is a trading name of The Big Picture Productions Limited, a company registered in England and Wales (Company number 2760297) and whose registered office is at Fulford Lodge, 1 Heslington Lane, York, YO10 4HW (‘we’, ‘us,’). They contain important information about the different ways you can access our platform and your rights and obligations.
FastCodeFix.com is provided to you subject to your agreement to the terms and conditions.

1. Introduction
1.1 By registering for one of the services for FastCodeFix.com on this site or via Facebook at https://www.facebook.com/fastcodefix/ and making payment you confirm you are over the age of 18 and agree to be legally bound by the terms and conditions (as they may be modified and posted on our website from time to time) which specifically relate to your access to FastCodeFix.com.
1.2 We refer you to the Glossary of Terms at the end of these terms and conditions as they define many terms which are used throughout these terms and conditions.
1.3 If you do not wish to be bound by these terms and conditions then you may not use FastCodeFix.com services.
2. What FastCodeFix is and how you may access it
2.1 The FastCodeFix website is a service which enables you as a Client to have FastCodeFix engage professional services on your website in the areas including but not limited to content creation, website design, website coding, mobile optimisation, website user experience analysis, hosting analysis and website performance optimisation.
3. Conditions for access to FastCodeFix
3.1 To gain access to FastCodeFix service you must first make contact using our site to request a quote for the work that you require doing.
3.2 If you are happy with our quote we will then send a PayPal invoice to you that will request payment. This invoice will also include any terms of engagement that have been defined in your quote.
3.3 Once payment is made we will begin work on your website and complete the work within the timeline that we have advised within the quote.
3.4 The nature of FastCodeFix means that any relevant passwords or account information in conjunction with the website that work is required upon must be provided to allow FastCodeFix to perform their duties. All details shall be kept secure and not disclosed to anyone unless in relation to the work required. FastCodeFix will also recommend the rotation of passwords to increase security by regularly changing the passwords that are required for access to your website.
3.5 The Service Level Agreement (SLA) for the engagement of our services will be defined in the quote that you will be provided with when enquiring about our services. When you engage in our services by making payment through PayPal the SLA details will be confirmed on the supplied invoice generated through the PayPal service.
4. Warranties as a FastCodeFix service user.
You warrant, undertake and agree that:
4.1 You have not entered into any arrangement which might conflict with the service provided by FastCodeFix and you are not under any disability, restriction or prohibition which might prevent you from performing any of your obligations under these terms and conditions.
5 Modifications to FastCodeFix
We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of the FastCodeFix service or the options available, including your access to it. Unless explicitly stated to the contrary, any new options including new services and/or new features shall be subject to these terms and conditions.
6 The Licence terms upon which we make FastCodeFix available to you.
6.1 Upon making payment as a client we grant to you a non-exclusive, non transferable, non sub-licensable and fully revocable license to use the FastCodeFix service provided you are in full compliance with these terms and conditions.
6.2 We may in our sole discretion add, change or delete features or functions or provide programming fixes, updates and upgrades to the FastCodeFix service.
6.3 You acknowledge and agree that the intellectual property in the FastCodeFix service belongs to us and is protected by copyright law and also represents a valuable trade secret and confidential information.
7 Additional terms and conditions which apply if as a Client you wish to upload Content to FastCodeFix
7.1 You may submit Content to us in either of the following ways;
i) You may submit the Content to us using the FastCodeFix Helpdesk.
ii) You may submit Content offline to us on condition that you have entered into a separate agreement.
7.2 When engaging our services as a client you will be provided with an account to access our helpdesk system at https://www.fastcodefix.com/helpdesk.
7.3 Communication through the Helpdesk system allocates unique tickets to be assigned to problems, questions, queries and requests.
7.4 You are not entitled to any compensation for any issues arising from the use of the information supplied in accordance with these terms and conditions.
8. Compliance with United Kingdom Law
We have used our best endeavours to ensure that our website FastCodeFix.com complies with the laws of England and Wales. However, we make no representations that materials on our website are appropriate or available for use in locations outside the United Kingdom. Those who visit our website from other locations do so on their own initiative and are responsible for compliance with all applicable laws. If use of our website and/or viewing of it, or use of any material or content on our website, or products offered through our website are contrary to or infringe any applicable law in your jurisdiction(s), you are not authorised to view or use our website or service and you must exit immediately.

We make no representations whatsoever about any other websites which you may access through our website or which may link to our website. When you access any other website you understand that it is independent from us and that we have no control over the content or availability of that website. 11 General
11.1 We may assign, transfer, novate or subcontract any or all of our rights and obligations under these terms and conditions at any time.
11.2 We may alter these terms and conditions from time to time and post the new version on our website, following which all use of our website will be governed by that version. You must check the terms and conditions on the website regularly.
11.3 These terms and conditions together with the Privacy Policy at FastCodeFix.com/privacy-policy and Cookie Policy at FastCodeFix.com/cookie-policy are the whole agreement between us. You acknowledge that you have not entered into these terms and conditions in reliance upon any statement, warranty or representation made by us or any other person and you irrevocably and unconditionally waive any rights to claim damages and/or to rescind these terms and conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) that is not contained in the terms and conditions, privacy policy or cookie policy.

11.6 Except in respect of a payment obligation, neither you nor FastCodeFix will be held liable for any failure to perform any obligation to the other due to causes beyond your or our respective reasonable control.
11.7 Failure or delay by either party enforcing an obligation or exercising a right under these terms and conditions does not constitute a waiver of that obligation or right.
11.8 These terms and conditions do not confer any rights on any person or party (other than you and/or us) pursuant to the Contracts (Rights of Third Parties) Act 1999.
11.9 No partnership or agency is created by your registering with FastCodeFix and neither party shall represent otherwise.
11.10 Neither you or FastCodeFix shall bring any proceedings against the other in respect of these terms and conditions unless the party intending to bring proceedings first makes a bona fide offer to participate immediately in a mediation conducted by a mutually agreed third party or a certified mediator and the other party has declined such offer. The costs of the mediator shall be borne by the party intending to bring proceedings but shall be subject to the mediation in any event. This clause shall not apply to the extent that one party requires immediate injunctive relief to protect its interests hereunder.
12. Notices
All notices shall be given:
- to us online at www.fastcodefix.com; or
- to you at either the email or postal address you provide during the payment process.
Notice will be deemed received when an email is received in full (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 3 days after the date of posting.
13. Glossary of Terms
Content: Information provided to us by the client to allow us to perform the functions listed in 2.1.
FastCodeFix: The website FastCodeFix.com, heldesk at FastCodeFix.com/helpdesk and the service provided by us which enables you as a Client to receive the services as listed in 2.1.
FastCodeFix Helpdesk: The software used at https://www.fastcodefix.com/helpdesk, using software as a service through Freshworks Inc.
Service: The service provided by us which enables you as a Client to receive the services as listed in 2.1.
SLA: Service Level Agreement. An agreement between FastCodeFix and the Client on the expected timeframe as listed in 3.5 for the delivery of the services as listed in 2.1.
Client: means a Client who engages the services of FastCodeFix as listed in 3.4.
By making payment for a service provided by FastCodeFix you confirm your acceptance of these terms and conditions.
